TuneHugs Terms of Service

These Terms of Service (“Terms”) govern your purchase and use of products and services offered through tunehugs.com.

TuneHugs is operated by Ilias Lepoureos, trading as TuneHugs, Aspasias 16, 156 69 Papagou, Greece.

By placing an order through TuneHugs, you agree to these Terms together with our Privacy Policy and Refund, Revision & Cancellation Policy.

1. About TuneHugs

TuneHugs creates personalized digital products using information, memories, preferences, stories and other details submitted by the customer.

A TuneHugs personalized product may include a personalized song, dedication, digital image, Memory Keepsake or other digital materials described on the relevant product page.

Each personalized creation is produced specifically for the recipient identified in the order and is not a pre-made or mass-produced product.

2. Eligibility

You must be legally capable of entering into a binding contract in your jurisdiction in order to place an order.

TuneHugs purchases are intended to be made by adults.

An adult may purchase a TuneHugs product as a gift for another person, including a child, provided that the customer is legally permitted to provide the information used for personalization.

3. Orders and Contract Formation

You are responsible for reviewing the information submitted with your order before completing your purchase.

An order is considered placed when payment has been successfully completed and TuneHugs issues an order confirmation.

TuneHugs may refuse or cancel an order where reasonably necessary because of suspected fraud, unlawful content, technical error, pricing error, inability to perform the requested personalization or another legitimate reason.

If TuneHugs cancels an order that has already been paid and no equivalent product is provided, the applicable amount will be refunded.

4. Customer-Provided Information

You agree to provide accurate and appropriate information reasonably required to create your personalized product.

The final creative result is based on the information you submit.

Because TuneHugs products are creative and personalized works, information may be interpreted, reorganized, shortened or adapted in order to create a coherent musical, written or visual result.

You are responsible for checking names, dates, relationships, spellings and other factual details before submitting your order.

5. Customer-Provided Content and Rights

You remain responsible for photographs, recordings, messages, stories, names, memories and other materials that you provide to TuneHugs.

By submitting such material, you confirm that you have the right or appropriate permission to provide and use it for the purpose of creating your personalized product.

You must not knowingly submit content that infringes another person's intellectual-property, privacy, publicity or other legal rights.

You grant TuneHugs a limited permission to use and process the material you submit only to the extent reasonably necessary to create, review, deliver and support your order, subject to our Privacy Policy.

6. Personalized Digital Content and Immediate Performance

TuneHugs products are personalized digital products created specifically for the recipient and circumstances described in the order.

By placing an order, you request that TuneHugs may begin preparing your personalized order without unnecessary delay.

Where applicable law requires separate express consent before performance begins during a statutory withdrawal period, TuneHugs will request that consent separately during the purchase process.

Any loss or limitation of a statutory right of withdrawal applies only where the legal requirements for that loss or limitation have been satisfied.

Nothing in these Terms removes any mandatory consumer right that cannot legally be waived.

For digital content in the European Union, a consumer may lose the statutory withdrawal right after access or performance begins only where the required express consent and acknowledgement have been properly obtained. European Union

7. Production and Delivery

Production begins after TuneHugs has received payment and the information reasonably necessary to create the order.

Where the relevant product page states a delivery period of up to 48 hours, that period begins when TuneHugs has received the information required to proceed with production.

A delay caused by missing, unclear or contradictory customer information, a requested revision, customer approval, or another action required from the customer may extend the delivery period.

Temporary technical failures, third-party service outages or circumstances outside TuneHugs' reasonable control may also affect delivery times.

Digital products are delivered electronically using the method described on the website or communicated to the customer.

No physical product is shipped unless expressly stated otherwise.

8. Review and Revisions

Where the purchased TuneHugs package includes a review or revision stage, the customer may be provided with a first version before final delivery.

Unless otherwise stated on the product page, the package includes one reasonable creative revision based on the information originally submitted with the order.

A revision may include reasonable corrections or creative adjustments.

A revision does not include creating an entirely new song or product, changing the recipient or occasion, replacing the core memories originally submitted, or requesting a substantially different creative direction.

Substantial changes or new creative work may require an additional charge, which will be communicated before any additional paid work begins.

9. Creative and Technical Variations

Personalized music and creative content involve subjective artistic choices.

Musical style, arrangement, vocal interpretation, pronunciation, rhythm, imagery, wording and other creative elements may vary.

TuneHugs will make reasonable efforts to create a high-quality personalized result that reflects the information supplied by the customer.

However, TuneHugs cannot guarantee a particular subjective artistic reaction or that every customer will prefer every creative decision.

A difference in personal artistic preference does not by itself mean that a product is defective or non-conforming.

10. Errors and Non-Conforming Products

If TuneHugs makes a material personalization error, or if a delivered digital file is defective, corrupted or inaccessible as intended, please contact us.

TuneHugs will provide an appropriate remedy in accordance with applicable law and our Refund, Revision & Cancellation Policy.

This may include correction, replacement, re-delivery or, where appropriate, a refund.

11. Prices, Payments and Taxes

Prices are displayed in the currency applicable to the customer or market where supported.

The final amount payable, including any applicable taxes or other mandatory charges collected through the checkout, will be shown before the customer confirms payment.

Payments are processed through Shopify Payments or other payment methods displayed at checkout.

TuneHugs does not normally receive or store complete payment-card details.

Prices, currencies, tax treatment and available payment methods may vary by country or market.

12. Cancellations, Refunds and Withdrawal Rights

Cancellation, revision and refund eligibility is governed by our Refund, Revision & Cancellation Policy and applicable consumer law.

Because TuneHugs products are individually created and personalized, cancellation or change-of-mind refunds may be limited once production or performance has lawfully begun.

However, nothing in these Terms excludes or restricts mandatory rights available under applicable consumer law.

13. Personal Use License

Unless otherwise expressly agreed in writing, TuneHugs personalized products are supplied for personal, non-commercial use.

You may listen to, download, store, display and privately share the delivered product with the intended recipient, family and friends.

You may also share reasonable portions or the complete product through your personal social-media accounts for non-commercial purposes, provided that doing so does not violate the rights of another person.

You may not resell, sublicense, commercially exploit, commercially distribute or offer the TuneHugs product as your own commercial product without prior written permission.

To the extent that TuneHugs owns or controls intellectual-property rights in a delivered product, TuneHugs grants you the personal-use rights described in this section.

Nothing in these Terms transfers ownership of third-party technology, software, music-generation systems, fonts, platforms or other third-party intellectual property.

14. TuneHugs Brand and Website Content

The TuneHugs name, branding, website design, original website text, graphics, trademarks and other business materials owned or controlled by TuneHugs may not be copied, reproduced or commercially used without permission.

Your purchase of a personalized product does not grant any rights to the TuneHugs brand, website or underlying production systems.

15. Artificial Intelligence, Shopify and Third-Party Technology

TuneHugs may use artificial-intelligence-assisted tools and other third-party technology as part of the creative, ecommerce and production process.

These technologies may assist with tasks including text creation or editing, music generation, image generation or editing, quality control, payment processing, ecommerce functionality, analytics, security, cloud processing, storage, communication and delivery.

Our online store is hosted by Shopify. Shopify collects and processes information relating to your use of the TuneHugs store in order to provide ecommerce, checkout, payment, security, analytics and related services.

TuneHugs currently uses Shopify Network Intelligence and certain Shopify Enhanced Services. When these services are enabled, Shopify may process information about your interactions with TuneHugs together with information from your interactions with other Shopify merchants and with Shopify. These services may be used to provide a more personalized shopping experience, improve store performance, understand customer interactions and provide more relevant advertising.

Information relating to your use of the TuneHugs store may therefore be shared with Shopify and authorized third-party service providers, including providers that may be located in countries other than your country of residence.

Where required by applicable law, TuneHugs obtains consent before information collected through non-essential cookies or similar technologies is used for advertising, personalization or other non-essential purposes. Available privacy and opt-out choices are described in our Privacy Policy.

No other Shopify merchant is permitted to directly access TuneHugs customer data through Shopify Network Intelligence.

TuneHugs remains responsible for providing the product purchased by the customer, subject to these Terms and applicable law.

Third-party service availability may occasionally affect production, checkout or delivery.

Personal information processed through Shopify, artificial-intelligence-assisted tools or other third-party services is handled in accordance with our Privacy Policy and applicable data protection law.

16. Prohibited Use

You may not use TuneHugs to create content that is unlawful, fraudulent, threatening, abusive, defamatory or that knowingly violates the rights of another person.

You may not attempt to interfere with the operation or security of the TuneHugs website, checkout, production systems or customer-delivery systems.

TuneHugs may refuse or discontinue an order where fulfilling it would reasonably expose TuneHugs or another person to legal, security or safety risks.

17. Availability of the Services

We aim to keep the TuneHugs website and digital services reasonably available.

However, uninterrupted availability cannot be guaranteed.

Maintenance, security incidents, infrastructure failures, third-party outages or other technical circumstances may temporarily affect access to the website or delivered services.

Where a purchased product or service is materially affected, TuneHugs will make reasonable efforts to restore access or provide an appropriate remedy.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

To the maximum extent permitted by law, TuneHugs is not liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the contract was formed.

Nothing in this section limits any mandatory statutory rights or remedies available to consumers.

19. Privacy

Personal information is processed in accordance with the TuneHugs Privacy Policy.

The Privacy Policy explains the categories of personal information we process, how personalization information is used, the use of technology and AI service providers, retention periods and the privacy rights available to customers.

20. Changes to These Terms

TuneHugs may update these Terms from time to time to reflect changes to our products, technology, business practices or applicable law.

The Terms applicable to an order are normally those in effect when the order is placed, unless applicable law requires otherwise.

The date of the latest version will be displayed at the beginning of these Terms.

21. Governing Law and Consumer Rights

These Terms are governed by the laws of Greece, without limiting any mandatory consumer protections that apply to you under the laws of your country of residence.

If you are a consumer, nothing in these Terms requires you to give up a mandatory right to bring a claim before a court or authority that has jurisdiction under applicable consumer law.

22. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
